DUTIES:
The incumbent of this position will have functional knowledge of, and actual work experience independently investigating, and serving as a Team Leader regarding federal Civil Rights complaints filed against health and human service providers and organizations that are covered entities and that must comply with the requirements of federal Civil Rights statutes and regulations, including Title VI of the Civil Rights Act of 1964, Section 504 of the Rehabilitation Act of 1973, Title II of the Americans with Disabilities Act of 1990, Section 1557 of the Affordable Care Act, and the Age Discrimination Act of 1975. The incumbent should also have knowledge of, and work experience of the following: the Privacy Rule, Security Rule, and Breach Notification Rule of the Health Insurance Portability and Accountability Act (HIPAA); the 2009 amendments to HIPAA necessitated by implementation of the HIPAA/HITECH Omnibus Final Rule; issues pertaining to Section 1557 of the Affordable Care Act, HIV/AIDS, limited English proficiency and language access, health care disparities, and the Title II/Olmstead Integration Mandate.
QUALIFICATIONS REQUIRED:
Specialized experience: One year of specialized experience (equivalent to the GS-12 grade level or higher in the Federal service) that included investigating allegations of discrimination, civil rights violations, or privacy issues; negotiating settlements to ensure compliance with federal civil rights and/or health information privacy and security laws and regulations; conducting compliance reviews and monitoring compliance plans; and developing strategies for outreach, technical assistance, and policy analysis related to civil rights and/or health information privacy.
Documenting experience: In accordance with Office of Personnel Management policy, federal employees are assumed to have gained experience by performing duties and responsibilities appropriate for their official series and grade level as described in their position description. Experience that would not normally be part of the employee's position is creditable, however, when documented by satisfactory evidence, such as a signed memorandum from the employee's supervisor or an SF-50 or SF-52 documenting an official detail or other official assignment. The documentation must indicate whether the duties were performed full time or, if part time, the percentage of times the other duties were performed. It is expected that this documentation is included in the employee's official personnel record. In order to receive credit for experience in your resume that is not within the official series and grade level of your official position, you must provide a copy of the appropriate documentation of such experience as indicated above.
